Welcome to BloodApp.Ai! Please carefully review these Terms and Conditions of Service (the "Terms" or “Agreement”) that govern your access and use of the Lunar Ventures Inc. d/b/a BloodApp ("BloodApp," "we," "us," and "our") website located at www.bloodapp.ai (the "Website"), and other BloodApp provided services, products, websites, and applications that link to or display this Privacy Policy (collectively with the Website and App, the "BloodApp Platform"). BY USING, ACCESSING, OR DOWNLOADING THE BLOODAPP PLATFORM, YOU ("user," "you" or "your"): (a) ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS; (b) REPRESENT THAT YOU ARE 18 YEARS OF AGE OR OLDER; AND (C) ACCEPT THIS AGREEMENT AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE OR ACCESS THE BLOODAPP PLATFORM.
1. General Terms of Use and Restrictions on Use.
Subject to these Terms, BloodApp grants you a limited, revocable, nonexclusive, nontransferable personal right to access and make use of the BloodApp Platform solely for the benefit of user and no other commercial purpose.
We may discontinue or alter any aspect of the BloodApp Platform or remove content from the BloodApp Platform at any time without prior notice. You agree that we may, under certain circumstances, immediately suspend or terminate your access to or use of the BloodApp Platform or any part thereof. Such circumstances include, without limitation: (a) breaches or violations of these Terms or other incorporated agreements or guidelines; (b) discontinuance or material modification to the BloodApp Platform; (c) unexpected technical or security issues or problems; (d) extended periods of inactivity; or (e) engagement by you in fraudulent, inappropriate, or illegal activities. You further agree that such measures shall be taken in our sole discretion and without liability to you or any third party.
2. Account.
While a user may browse the Website without creating an Account, a user will need to have an Account and agree to the terms of this agreement in order to use certain features of the BloodApp Platform, including the App. To create an account, you will be required to provide certain information, including some Personal Information, such as your name and email address, and create a password or use your Facebook or Google login credentials (an "Account"). Once you create your Account, you will have access to a one-time free session (the “Trial Period”). Unless otherwise stated on the BloodApp Platform, you will not be required to enter your billing information during the Trial Period. We reserve the right to terminate your Trial Period if you do not sign up for a Membership within a reasonable amount of time. A "Membership" means the package with your choice in the App. Upon beginning your Membership, you will be required to enter your billing information. A Membership is currently offered for a term of one month (the “Membership Term”) and shall automatically renew each month until you choose to cancel pursuant to Section 4 of this Agreement. By creating an Account, you agree that we may send and you agree to receive (a) messages or push notifications from us through the App and (b) informational or promotional emails to the email address used to create your Account. If you do not wish to receive push notifications, please change your settings on your mobile device. If you do not wish to receive emails, please select the unsubscribe option in the body of the email.
You are responsible for maintaining the confidentiality of your username and password associated with your Account and are fully responsible for all activities that occur under your Account. You are prohibited from sharing your Account with, or assigning your Account to, any other person without our prior written authorization. You also agree that you will provide truthful and accurate information that belongs to you during the sign-up process. Should you become aware of or suspect any unauthorized use of your Account or your information changes, you must immediately notify us. You will ensure that you log out of your Account at the end of each session.
If you access the BloodApp Platform using your mobile device or choose to connect using text messages or SMS outside of the BloodApp Platform, you understand that your mobile network provider may charge you fees for your use of its network while accessing or using the BloodApp Platform, for data downloading, or roaming, and that YOU ARE SOLELY RESPONSIBLE FOR SUCH FEES AND CHARGES.
3. Children.
The BloodApp Platform is not directed to persons under the age of 18 and is not aimed or intended for children under the age of 13. If you are under the age of 18, please DO NOT USE the BloodApp Platform. By using the BloodApp Platform, you represent and certify that you are 18 years of age or older.
4. Service Fees and Cancellation.
(a) Service Fees. The fees associated with the Membership can be found in the App. Please refer to the pricing listed at the time you begin your Membership for your applicable Membership fees. We will charge you for your selected Membership using the services of a third-party service provider that processes payment transactions (the “Payment Processor”). By using the BloodApp Platform and enrolling in a Membership, you agree to pay us, through the Payment Processor (as defined below), all charges at the prices then in effect for the services provided under your Membership in accordance with any applicable payment terms. The processing of payments is subject to the terms and conditions and privacy policies of our Payment Processor. By enrolling to use the BloodApp services, you agree to pay the recurring Membership fees, which shall renew at the start of each Membership Term.
(b) Cancellations. You may cancel your Membership at any time by following the instructions provided in the App. Unless otherwise stated in these Terms, you will not receive a refund for any unused portion of your Membership Term. Cancellations are effective immediately and you will lose access to any remaining sessions or benefits of your Membership. If you wish to cancel your Membership, you must do so before your Membership Term renews. Please note that if you purchase a Membership, it is your responsibility to cancel your Membership before it renews for the next Membership Term in order to avoid being charged the next Membership’s fees.
5. AI-Generated Content Disclaimer.
Users acknowledge that certain content or responses provided by BloodApp may be generated by artificial intelligence algorithms. While we strive for accuracy, AI-generated content may not always be accurate, complete, or appropriate, and should be used at the user's own discretion and risk.
6. No Warranty on AI Outputs.
BloodApp expressly disclaims all warranties, express or implied, regarding the accuracy, reliability, or appropriateness of AI-generated content. Users understand and agree that while BloodApp endeavors to provide accurate information, the AI may not always provide correct or contextually appropriate responses.
7. User's Responsibility.
Users are solely responsible for critically assessing, verifying, and interpreting any AI-generated content before making decisions or taking actions based on such content. Reliance on any information provided by BloodApp is solely at the user's risk.
8. Limitation of Liability for AI Errors.
To the maximum extent permitted by applicable law, BloodApp shall not be liable for any damages, losses, or issues arising from the use or reliance on AI-generated content, including, but not limited to, any decisions made or actions taken based on such content.
9. Updates and Continuous Learning.
Users acknowledge that BloodApp's AI models evolve and improve over time. As such, the outputs or suggestions may change as the system undergoes updates and refinements. Users understand that AI-generated content provided today might differ from content generated in the future based on continuous learning and new data inputs.
10. Feedback and Corrections.
Users are encouraged, though not obligated, to provide feedback regarding any perceived inaccuracies or inappropriate content generated by the AI. Such feedback is invaluable for the continuous improvement of BloodApp.
11. Content Review Mechanism.
BloodApp may, at its discretion, implement mechanisms to review certain AI-generated content by human experts before dissemination. However, there is no obligation to do so, and users should not rely solely on this potential review when using the platform.
12. Content Moderation.
BloodApp reserves the right, at its sole discretion, to remove, modify, or correct any AI-generated content that is deemed inappropriate, offensive, misleading, or in violation of these Terms and Conditions.
13. Indemnification.
Users agree to indemnify and hold harmless BloodApp, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or in connection with their use of or reliance on AI-generated content provided by BloodApp.
14. Privacy.
Your use of the BloodApp Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. You may review the Privacy Policy by clicking on the "Privacy Policy" link located on the BloodApp Platform.
15. Modifications.
We may modify these Terms at any time. It is your responsibility to review these Terms periodically. Your continued use of the BloodApp Platform following the posting of any changes to these Terms constitutes your acceptance of those changes. If you do not agree to any changes to these Terms, your sole remedy is to stop using the BloodApp Platform.
16. Dispute Resolution.
All disputes arising out of or relating to these Terms or your use of the BloodApp Platform will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. You agree that any dispute arising out of or related to these Terms or the BloodApp Platform is personal to you and BloodApp and that any dispute will be resolved solely through individual action, and will not be brought as a class arbitration, class action, or any other type of representative proceeding.
